RELOCATION

Relocation cases are tough. If you want to move out of your child’s school district or just received a Notice of Relocation, the first places to look are Section 3.14 of your parenting plan and RCW 26.09.430-.530, the statute governing relocations. There are specific requirements regarding proper notice, filing an objection and temporary orders. If the parents cannot agree on a new parenting plan, there can be a relocation trial if the correct procedures are followed. Certain presumptions allowing the relocation apply depending on the circumstances. The Court will consider 11 factors set forth in RCW 26.09.520.
